1. Scope and Conclusion of Contract
1.1. These Terms and Conditions (hereinafter referred to as “T&C”) apply to all orders of goods (the "Products") that you place through the OneFootball app.
1.2. By completing an order, you (hereinafter referred to as “Buyer”) agree that these T&C are binding for all transactions between you and our partners (hereinafter referred to as “Sellers”). The T&C apply regardless of your place of residence or stay. If individual provisions of these T&C are not applicable or invalid due to national laws in your country, the validity of the remaining provisions remains unaffected.
1.3. By placing an order, you confirm that you are purchasing the goods exclusively for private purposes. The sale of goods is directed at consumers who do not purchase for commercial or professional purposes. Additionally, by placing an order, you confirm that you are of legal age and legally competent.
1.4. These T&C are concluded exclusively in the German language. An English translation of these T&C is provided for informational purposes only. The German text is legally binding.
2. Contractual Relationship and Delivery Obligation
2.1. OneFootball offers third-party Sellers the opportunity to list and sell their products on the OneFootball App. This is clearly indicated on the respective product page. OneFootball only provides the platform for processing transactions. OneFootball is neither the Buyer nor the Seller of third-party products offered on this platform. The purchase contract is concluded exclusively between the Buyer and the Seller.
2.2. OneFootball is not a party to the purchase contract and therefore assumes no liability for it. The Seller is solely responsible for the sale of its products, the handling of any complaints from the Buyer, as well as all other matters arising from the contract between Buyer and Seller.
2.3. By clicking “Buy Now,” you place a binding order. You will receive an order confirmation via email, which establishes the contract between you and the Seller.
2.4. By accepting these T&C, you agree that the Seller may assign their payment claims to third parties, in particular to approved payment service providers.
2.5. The Seller does not bear the risk of procuring the goods (so-called “procurement risk”). This also applies to goods that are described only by their type and characteristics (generic goods). The Seller is only obligated to deliver goods from their own stock or goods already ordered from their supplier.
2.6. The Seller is not obligated to deliver if they have properly ordered the goods themselves but have not been supplied correctly (so-called “congruent covering transaction”). This does not apply, however, if the Seller has individually assumed the procurement risk contrary to Section 2.5, is responsible for the unavailability of the goods, or has failed to inform the Buyer promptly about the unavailability.
2.7. If the Seller is not obligated to deliver for reasons mentioned in Section 2.5 or 2.6, any payments already made will be refunded promptly.
2.8. Orders placed by automated programs such as crawlers, spiders, or scripts may be rejected. For clarification, this restriction does not apply to programs that assist people with disabilities.
3. Prices
3.1. The prices at the time of the order apply, including the applicable VAT.
3.2. The goods remain the property of the Seller until full payment has been received.
4. Delivery and Shipping Costs
4.1. The delivery time is specified on the Seller’s product page. If business days are indicated as the delivery time, this includes all days from Monday to Friday, excluding public holidays, whereas public holidays mean those at the Seller's location and the shipping destination as both may delay the indicated delivery time.
4.2. Shipping costs are based on the shipping cost list published on the OneFootball App at the time of order. This also indicates to which countries the Seller generally ships.
5. Payment and Invoicing
5.1. The available payment methods are credit card, debit card, Apple Pay and Google Pay. However, in some cases, not all payment methods may be available.
5.2. Any fees charged by the Buyer’s bank or credit card provider are borne by the Buyer.
5.3. By accepting these T&C, you agree to receive invoices and credit notes in electronic form, e.g., as a PDF file via email from OneFootball and/or the Seller.
6. Right of Withdrawal
6.1. You have a statutory right of withdrawal when purchasing goods.
6.2. However, this right of withdrawal does not apply to goods that are made to your specifications or are clearly personalized.
6.3. A statutory right of withdrawal expires prematurely in the case of sealed goods that are unsuitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.
6.4. The right of withdrawal is excluded for orders made by non-consumers contrary to Section 1.3 of these T&C.

7. Refunds
Refunds are automatically made to the account used for payment, such as a bank account, credit card, or PayPal account.
8. Warranty
All goods are subject to statutory warranty rights. If the goods are defective, you are entitled to statutory warranty rights.
9. Storage of the Contract Text
9.1. The T&C can be viewed and downloaded in the OneFootball app or on the OneFootball website.
9.2. You can save the T&C and the data of your order by downloading the T&C and saving the order data using your browser’s functions or taking a screenshot using your mobile phone's functions (app). Additionally, you will receive an order confirmation via email that contains all relevant data.
10. Dispute Resolution
10.1. The European Commission provides an online dispute resolution platform, which you can access at the following link: http://ec.europa.eu/consumers/odr/.
10.2. OneFootball and the Sellers do not participate in dispute resolution procedures before a consumer arbitration board.
